1. About These Terms
These Terms of Service govern your use of the Launch Portugal platform and services provided by Launch Portugal, Lda. ("we", "us", "our"), a company registered in Portugal. By using our services, you agree to these terms.
2. Services
We provide business setup and compliance services for entrepreneurs establishing businesses in Portugal. This includes NIF acquisition, company registration assistance, bank account introductions, social security enrollment, accounting referrals, and visa guidance documentation.
Important: We are not a law firm. Legal services are provided by our co-founder (a licensed Portuguese lawyer) and partner firms. Visa guidance documents are informational and do not constitute legal representation before immigration authorities. Accounting services are delivered by our certified accountant partners.
3. Packages & Pricing
Prices are listed in Euros (EUR) and include VAT at the applicable Portuguese rate. Prices may change, but confirmed orders honor the price at the time of purchase. Government fees (e.g., €360 for Empresa na Hora, €75 for CAF) are separate and clearly disclosed before payment.
4. Payment
Payments are processed via Stripe. By completing a purchase, you authorize the charge. For recurring accounting plans, your card will be charged monthly on the anniversary of your subscription start date. You can manage your subscription through the Stripe Billing Portal in your account.
5. Refund Policy
Service-related refund: If we are unable to deliver the core service you purchased due to our error, we will provide a full refund of our service fee.
Government fees: Fees paid to Portuguese government entities are non-refundable once submitted.
Cancellation before work begins: Full refund if you cancel within 48 hours of purchase and we have not yet started processing your request.
Cancellation after work begins: Partial refund proportional to work not yet completed, at our reasonable determination.
Recurring plans: Cancel anytime. No refund for the current billing period. Access continues until the end of the paid period.
6. Your Responsibilities
You agree to: provide accurate and complete information; upload authentic documents; respond to our requests within reasonable timeframes (delays may extend delivery timelines); comply with Portuguese law; not use our services for illegal purposes including money laundering or tax evasion.
Delays in providing required documents or information may extend our delivery timelines beyond the estimates provided.
7. Delivery Timelines
Estimated timelines (e.g., "5–7 business days") are our best estimates and depend on Portuguese government processing times, partner availability, and your responsiveness. We are not liable for delays caused by government agencies or your failure to provide required information.
8. Intellectual Property
All content on our website (text, design, code, brand) is our intellectual property. Contract templates provided as part of Professional and Enterprise packages are licensed for your business use only and may not be redistributed or resold.
9. Limitation of Liability
To the maximum extent permitted by Portuguese law: our total liability is limited to the amount you paid for the specific service giving rise to the claim; we are not liable for indirect, incidental, or consequential damages; we are not liable for losses arising from government decisions, delays, or policy changes.
10. Data Protection
We process your personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). By using our services, you acknowledge and accept our data processing practices as described therein.
11. Termination
You may close your account at any time through your account settings. We may terminate or suspend your account if you violate these terms, provide fraudulent information, or use our services for illegal purposes. Upon termination, data is handled per our Privacy Policy.
12. Governing Law & Disputes
These terms are governed by Portuguese law. Any disputes shall first be attempted to be resolved amicably. If resolution is not possible, disputes shall be submitted to the courts of Lisbon, Portugal. EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/odr.
13. Changes
We may modify these terms with 30 days notice via email. Continued use after the notice period constitutes acceptance. Material changes affecting ongoing service agreements will not apply retroactively.
